Abstract:
At this point I would like to address my readers the reasons why this work is so important. We have highlighted the major points of my research, the purpose to have written this subject and have shown what lesson gained during this work and what conclusion I got.
Indeed, in this work under the title ‘Trade Liberalization and the Protection of Human Rights in EAC”, we have shown how this research is relevant not only academically but also socially and economically. We have achieved the new knowledge and shown how the EAC States could reorganize their trade respecting the human rights.
By here, the reason to write this work was the reminder to the EAC States for the interest to have opened the trade among them just for the improvement of the life conditions of their people, for each one. In fact, the title of human rights was analyzed with trade liberalization in EAC thinking about rights of people should get from such politics.
We have used the analytic and synthetic method and exegetic method for interpretation of legal instruments. The legal instruments we had, were the EAST AFRICAN protocols mainly the protocol for the Establishment of the East African Community Customs Union for 2017; the protocol on the establishment of the East African Community Common Market, the protocol on the Establishment of the East African Customs Union; the protocol of the establishment of the East African Community Monetary Union.
We have presented the problematic step of this work showing how trade liberalization rules affect a wide range of aspects of the economy and when it is conducted with no regards to ‘human rights dimension’ and ‘social safeguard has negative impact in many spheres of human life. Not only we have written the challenges to traders themselves doing commerce in EAC boundaries but also the gain the countries get from trade is economically critical.
The have written the problem of insecurity and political instability happened in the area, weak bilateral cooperation among the country’s members of EAC, all this it is disturbance to people doing trade and the rights defined to citizens were not achieved. We have also showed the problem of environment which are not fit, weak trade infrastructures in some countries, some extra –borders crimes.
After the presentation of problematic, our findings: The EAC States could control the movement of people thinking about the extra-borders crimes which are actual. The struggle will be also realized to protection of environment. The States will control the transportation facilitations, the balance of export and import widely in the territory, sharing the investment incentives, bilateral and multilateral aid and improving cooperation among them. Each State will be aware of the economic profit gained to contribute to the improvement of its socio-economic areas improving the life conditions of vulnerable people, thinking about rural development, diminution of the cost of health, reduction of poverty of the citizens.
Finally, the trade liberalization and human rights including the right to live, right to private life, to development, to education, to health ,to food security ,we have found this obliges the States members to control security and peace ,struggle against crimes and make good relation among them every time respecting and revising the legal instruments created and other imperatives ad hoc.
